Brother in law charged in Cedar Rapids murder case

Malacas, 26, was killed March 9 in the 3620 12th Ave SW apartment shared with Shirley Buenaventura and her husband John Buenaventura. A friend found the body in a storage closet Sunday. Shirley filed a missing person report after Malacas failed to show for work. Detectives worked at the scene Thursday. Prosecutors must prove willful premeditation for first degree or that a rape or robbery occurred for a first degree charge. Second degree carries up to 50 years. Their church community called it tragic.
