Deaths list two local residents. Thomas William Mackey, 43, of Ely route 1, died in a local hospital at 5 30 p m Friday. Mrs Charles Whittenbaugh, 65, of 1548 D avenue NE, died at her home at 1 25 a m Saturday.
At 7 48 a m Saturday a chimney fire occurred at Frances Kilberger 218 Eighth Street NE with 10 minutes response and no damage. Engine Companies 1 3 and hook and ladder assisted. At 9 43 a chimney fire at 1945 B Avenue NE in Mrs Neely Hill area still alarm company No 3 responded.
Mercy hospital reports a daughter for Mr and Mrs Jarvis Freeman of 116 Sixth Street NE on March 1 and a daughter for Mr and Mrs John Shatzer of 1558 Fiftieth Street NE on March 2. Word arrived of a son, Paul Aaroyn Dominic, born to Mr and Mrs Dellman Lynn in Chicago on February 29. Mrs Lynn is Evalyn Ryan of Cedar Rapids.
Clarence F. Arthur of Esther ville and Florence J. Sexton of Cedar Rapids, Vincent R. Gough and Helen Margaret Hedges of Mount Vernon, Thomas G. Jones and Odella Jackson of Cedar Rapids, Ray Harry Avis of Coggan and Ruth Marline Price of Walker, Leslie L. Jackson of Nekoosa Wis and Sara G. Golla of Stevens Point Wis, William M. Johnson and Eleanor J. Wilson of Chicago.
Virgil G. Smith pleaded guilty to assault against Grace Kelly and received 30 days in county jail with 25 suspended for good behavior in Justice H. R. Churchill's court. Irving Fitzpatrick, 20, of 2117 Mount Vernon Avenue SE, was fined $5 plus costs for driving without a license in the same court.
Baton Rouge, La. Two sharp blows eroded the Huey P. Long machine. Gov Earl K Long abandoned his bid for a special session as the state central committee rescinded endorsement of Earl Long as secretary of state. Only 13 of 39 senators backed the session, failing to reach quorum and delaying the transfer of power to Sam Houston Jones.
The German freighter Heidelberg has been captured by a British cruiser and towed to Trinidad after leaving Aruba. This follows the destruction of the 2,390 ton Troja, which was set afire rather than surrender to a British cruiser. The Heidelberg, a 6,530 ton passenger and freight liner, operated between U S gulf ports and German ports before the war.
Bill Shaw of Milwaukee escaped injury when his Reliable Transfer semi trailer skidded on a grade two miles east of Clarence on highway No. 30 Saturday morning, overturning into a ditch. The trailer loaded with merchandise and the tractor were damaged.

London reports the appointment of Charles Rist and Frank Ashton Gwatkin to travel to Washington to smooth blockade issues with the United States. The pair will ride aboard the S S George Washington and assist British and French ambassadors in examining problems with American government departments.
Washington AP The House passed a revised Senate bill to allow federal and state cooperation to eliminate stream pollution. The measure cleared without a record vote and returns to the Senate for approval of changes. The main change omits grants to states or sub divisions for pollution control equipment.
The tenth annual Cedar Rapids Small Stock show finished with 300 plus entries from sixteen states. Winners span many breeds including Viking 3 Cedar Rapids senior buck and E J Harbertson Ogden Utah senior doe, with multiple winners named from Marion Davenport Omaha Canandaigua and other towns.
In Kansas City a split within the political camps set for a April 2 special election. Boss Tom Pendergast led machine backs Flavel Robertson for mayor while anti machine forces nominate John B. Gage. The machine also fields its own slate of council candidates with a fused anti machine coalition forming opposition.
Des Moines AP The state printing board must appeal to the interim committee for funds to cover printing and binding of the 1939 code. Attorney General Everettt says the cost should be borne by the printing board, not the code editor, after the blank check funding was repealed. The board’s $150,000 yearly appropriation isn’t enough beyond June 30, with $75,000 allotted to the editor for editing and indexing. printing costs run about $37,500.
A caucus in Atkins nominated candidates for the town election on March 25. Citizens slate includes mayor R C Risch and councilmen H J Wehrman C G Freeman Elmer Schueler Irvin Keiper A K Rinderknecht, with treasurer L W Lensch. People's slate lists mayor H A Haerther councilmen Carl Williams Iva Dunn C W Haerther Carl Lieb Gene Miller assessor Henry Alden treasurer W G Haerther.
Paris reports seven day restrictions on food and drink under a wartime program. Decrees ban beef, pastry, sweets, and alcohol on most days, with Sunday allowances capped. Bread and ration cards will curb meals, soups, hors d oeuvres, and vegetable portions, while gasoline pricing remains fixed at Sept 1, 1939 levels. A general census aimed for April 1 precedes ration card distribution.
In Chicago the American Newspaper Guild and the Chicago Newspaper Guild local No 71 were fined 9176.90 by the superior court for contempt of court for violating an injunction limiting picketing of the Chicago Herald American and advertisers. Judge John J Lupe upheld the master in chancery report.
In a counterclaim to Andrew Condon’s quieting title suit, Catherine Lynch asserts a one third interest and asks for quieting title and a writ of possession. Velma L. Danner and Lynch allegedly obtained the sheriff’s deed and agreed to sell to Albin F. Drahos and Anna C. Drahos. The answer argues Condon is barred by delay from challenging the judgment or execution leading to the deed.
Judge H C Ring Friday overruled an application by Wendl Trachta to set aside a court order approving the report of sale of College township farm real estate in the Frank Kriz estate at 18300 dollars to permit a 20000 dollar offer by Trachta to be considered.
Irwin P. Coppock, in a Friday defense answer, asks dismissal of a $403.80 sales contract suit filed Jan. 11 by Robert Morrison, Inc. He claims he rescinded the car exchange sale agreement and contests alleged representations and terms in the transaction.
A $312.78 truck damage and personal injury case filed February 23 against Century Cab company and defendants Bradley Carlton Gerald Pettit and Lloyd Wray was dismissed Friday as to Bradley Carlton by plaintiff Rudolph E Fisher.
Ernest Freeman and Company of Chicago filed a $970.50 claim for materials apparatus and installation Friday in the receivership of Stark Construction company of Cedar Rapids. A separate maintenance action filed Feb. 15 by Hazel B. Spinka against Frank A. Spinka was dismissed Saturday by plaintiff without prejudice. The two were married in Lee County Aug. 29, 1928.
Mrs Martha Christensen files a $123 rental claim against defendants D R Jones and Mrs D R Jones. The case identifies Martha Christensen as plaintiff with D R Jones and Mrs D R Jones as defendants in a small claims filing.
City council met Saturday morning and adjourned after approving the regular semi monthly labor payroll. Theft report: Carl Bailey, 525 C avenue NE, said a $25 yellow gold wrist watch was taken from his buffet after he left it there Tuesday. he noticed the loss Friday night.
Harry Whitehead, 54, of 503 Seventh Avenue SW, was treated at St Luke's Hospital Saturday morning for cuts below and above his left eye after a door slammed in his face at the Witwer Grocer Company.
