J C man sues city over housing development downsizing

Robert Hegeman of 44 Tucson Place sues the city and City Council in Johnson County District Court alleging the west side housing project was downsized to invalidate a protest petition filed by neighbors. He says formal notice and a separate hearing were required, while officials claim the reduced rezoning area avoided affecting additional property owners and avoided another hearing. The petition, signed by over 20 percent of nearby landowners, would have demanded a supermajority but the council approved the scaled project 5-2 in May.
