Luther Professor Cleared of Criminal Trespass
Decorah Luther College chemistry professor Dr. George E. Knudson was acquitted by a Winneshiek County magistrate court jury in the first such trial under the 1971 criminal trespass law. The case arose after farmer George W. Smith alleged Knudson trespassed while docked on a riverbank and walked a small creek on Smith land while fishing. Knudson admitted docking and walking on private land but said no evil intent or damage occurred and had permission to fish, though Smith's son-in-law Tim Hutchinson contradicted that claim. The jury ruled for Knudson after about an hour of deliberation. he noted he sought permission and did not catch any fish. Knudson serves on the state preservation advisory board. Smith is a member of the Upper Iowa River Preservation Association.
