Alcohol test banned in trial acquits driver
A 19 year old southwest Cedar Rapids woman, Denise Helms, was acquitted of a drunk driving charge by a Linn District Court jury. The jury could not consider a blood alcohol test result because the test was suppressed by a pre trial ruling requiring arrest before testing. The trial began Monday in the First Avenue division with testimony citing odor of alcohol and slurred speech. Helms was involved in a May 15 one vehicle crash on Mount Vernon Road SE, near Wilder Drive, injuring herself. Her BAC was .241 percent, but the result was not before the jury due to the suppression ruling.
