Judge rules officer complaint belongs before civil service panel
A Linn County judge ruled that Marion Police Officer Rodger Greear's challenge to his reclassification should be handled by the Marion Civil Service Commission, not the court. The judge sustained the city's bid to dismiss, saying the case hinges on a commission decision and could reach the court only if appealed. Greear contends he has served as a detective since July 8, 1984 but is paid as a patrol officer and seeks higher detective wages. He also seeks protection against a Jan. 4 reassignment discontinuation. The city argues the suit should not block Greear’s reassignment and cites a June 7, 1984 notice planning temporary investigative duties for patrol officers.
