Iowa Supreme Court limits out-of-state bank charges
The Iowa Supreme Court ruled that an Omaha Nebraska bank must follow the Iowa Consumer Credit Code for finance charges on Bank of America credit cards issued to Iowa residents. The decision, written by Justice M L Mason, states Nebraska law does not override Iowa limits. The ICCC caps 18 percent on balances up to 500 dollars and 15 percent on larger amounts. Nebraska allows 18 percent up to 999.99 dollars. Attorneys General Turner and the involved banks pursued the case since 1974, with litigation moving between Polk County and federal court before returning to state court.
