Pool firm sues Iowa state over three year plan review delay
Custom Fitness owned by Jason Bailey and Whole Health Natural Foods LLC sues the Iowa Department of Inspections Appeals and Licensing in Polk County District Court, alleging the state and Linn County have refused to review its March 2021 pool and spa plans and permit application for more than 1,200 days. The suit seeks a declaration that replacements to a water heater and filters are not reconstruction and demands damages for losses and potential punitive relief.
