Mrs. Viola Bivens Newman, 41, wife of Thomas B Newman of 827 Fourth Ave SE, died in a local hospital at 7:05 am Sunday from exposure after being found lying behind McKinley School. She had been missing since Saturday evening. A Century cab driver alerted police after learning a woman lay behind the school. Patrolmen DeVore and Bukacek summoned an ambulance and Dr J J Terrall, deputy coroner, noted no inquest. Newman last saw her at 6 pm Saturday. Mrs Newman, born April 15, 1896 in Tinous, had lived here 19 years.

Japan handed a formal protest to Soviet Russia over military assistance to China. Ambassador Mamoru Shigemitsu warned Soviet Foreign Commissar Maxim Litvinov that Russia must take responsibility for consequences if aid continued. City council members were reseated in a noon ceremony at city hall with Mayor Frank K. Hahn and Councilmen sworn in by Judge Thomas B. Powell. Don Hines was reappointed city attorney and Harry Johnson as assistant city attorney. Hines was sworn in by Judge Powell. A sine die adjournment preceded the noon meeting. The council will meet 10 a.m. Tuesday for further appointments. No changes in appointive officers are anticipated.
