David G. Bleakley city attorney plans to file in district court Friday a motion to dissolve the temporary injunction barring Chief W C Benesh and Public Safety Commissioner Dan Kruidenier from suspending or depriving 73 year old Detective Mike McGuire of pay. The motion argues rule 1 used to justify the injunction is inconsistent with Iowa law and that defendants had no notice or opportunity to be heard. It also claims McGuire, who was suspended over alleged gossip bribery and morale issues, is not subject to their directives while the writ seeks to protect department discipline.
