Washington July 7 The senate adopted a resolution submitting to state legislatures the question of amending the constitution to provide for an income tax. Debate focused on the administrative provisions of the bill and the Brown resolution. Senator Rayner attacked the customs court feature as unconstitutional for lacking trial by jury, while Root opposed the court's creation. The provision was amended to exclude criminal cases and adopted without division.
In a rapid customs session the Senate pushed most items other than the tobacco tax, with several amendments by Senator McCumber to aid northwest grain producers and other minor changes approved. Senator Brown of Nebraska won approval for an income tax resolution urging constitutional change to permit nationwide income taxation without apportionment. Debate lasted about three hours, Bailey proposing state conventions in place of legislatures.
The amendment was defeated while the Brown amendment was adopted unanimously, marking a decisive shift in the measure. The proceedings showed clear majority support for Brown and rejection of the earlier proposal.
The Colorado Supreme Court upheld the local option law confirming that if a ward votes dry and a single precinct is wet the ward must be dry. The ruling enables South Canon residents to vote the saloons out of Prospect Heights, a measure many citizens support.
