Elderly Tax Deferral Rules On Homestead Limits Suitbacks
Burran explained that once a homeowner files an over sixty five tax deferral affidavit with the appraisal district no taxing unit can sue for delinquent taxes while the owner resides in the homestead. The deferral postpones payment of delinquent taxes but does not cancel them and interest continues to accrue during the deferral period. When ownership or occupancy ends the accrued amounts become due and taxing units may sue for all deferred tax and interest. Penalties existing before deferral are not forgiven and an extra penalty can apply if taxes stay delinquent more than 90 days after the deferral ends.
