Buyer Must Take Possession Judge Walsh Declares

Judge John Z. Walsh of the Common Pleas Court ruled in Irving Stein vs Matheson and Beach that a buyer who allows the seller to retain property after sale loses recourse if the seller then disposes of it. Stein sued for an automobile purchased from Sabin, left with Sabin to sell within 30 days, Sabin fled, and after 80 days the car remained with the defendants. The judge found that possession by the vendor after sale creates a presumption of fraud that cannot be overcome by evidence of a bona fide or valuable consideration.
