Probate Court Lacked Power to Jail Hefferon in 1917 Case
Hartford November 8 Judge Edward L. Smith ruled in habeas corpus that the Probate Court had no authority to commit Thomas Hefferon to jail or to the state farm for inebriates under a 1917 act. The ruling voided a 184 day county jail sentence and questioned the trustees' power to order confinement without criminal charges. Attorney General Hinman argued the probate order implied alternative sentencing by trustees of the state farm.
