Fairfield Wins Damage Action by Non-Suit
Judge Isaac Wolfe in Superior Court ruled yesterday that the civil action brought by John Brita Jr. against the Town of Fairfield is dismissed without a trial. Defense evidence showed the street where the four year old plaintiff was injured on Churchill Street near Grasmere was a private thoroughfare not accepted by the town, and no obligation to repair private streets existed. The child claimed loss of sight from flying glass and injuries after being unseated in an automobile due to nuts and holes on the road.
