Commissioners Move to Restore Fire Lieutenant Status Demotion
State's Attorney Homer S. Cummings filed a mandamus applicat ion with Superior court to compel the fire commission ers to show cause why Elmer V. Fitzgerald should not be restored to lieutenant. Attorney Thomas M. Cullinan prepared the filing on behalf of six firemen demoted after probationary appointments were withdrawn. The hearing will be set after Judge Keeler' s response, with four commissioners plus Mayor Wilson cited. Allegations claim no three concur r ent votes existed and due process was not followed, as Dawe and Noonan voted for demotion while Finnegan and Cassidy opposed it, with Mayor Wilson breaking the tie for demotion.
