High Court Rules States May Not Restrict Carriers
The Supreme Court rules states cannot compel private carriers to operate as public common carriers for hires on highways when not engaged as public carriers. Michigan and Washington cases hold state insurance and licensing regulations apply only to businesses using state highways, not to private carriage operations crossing borders. The decision limits state power over interstate motor transport in favor of private carriers and underscores the balance between state health and safety regulation and federal commerce concerns.
