The Gee Pauper Case In New Hampshire Supreme Court
In Newport on September 4 Judge Bingham fined Emma T Cornish $500 plus costs for bringing pauper Emma R Gee from Massachusetts to Claremont in violation of state law. Judge Humphrey returns verdict in East Norfolk district court on the Old Colony railroad disaster at Quincy. The jack on the track caused the wreck and Joseph Welch is found criminally negligent for allowing it and grosser negligence for not removing it before the train’s arrival. Michael Hartley, directed by Welch, placed the jack and acted to remove it as danger grew. Hartley’s one attempt to avert disaster came under imminent risk to his life. The ruling notes Welch was unfamiliar with the jack, and Hartley had worked under him that month. the case suggests tighter restrictions on use times and locations of the jack.

Nantasket Braca September 4. A reunion and banquet at Hotel Nantasket gathered about forty former Fitchburg Railroad employees from before 1850. Attendees included David Chambers the companys first employee in 1842, engineer on the Charles Town branch, and the first passenger trains to Waltham in 1843 and Fitchburg in 1845. Also present were W A Kidder fireman on the 1845 trip and John T Bagley a bridge builder, with George Y Wellington who helped survey the road.
