New Trial Ordered in Coal Cases
In St Paul on November 19 Judge Walter H. Sanborn of the United States Circuit Court of Appeals set aside a guilty verdict and ordered a new trial in the United States versus Union Pacific Coal Company Union Pacific Railway Oregon Short Line James M Moore and Everett Buckingham. The ruling holds there was no substantial evidence of any coal company conspiracy to restrain trade under the Sherman act. The opinion states a combination must substantially restrict interstate commerce to be illegal. a coal firm may set its own prices and terms and refuse sales without violating the act. The decision also notes non participating stockholders are not criminally liable for corporate violations.
