Federal Judge to Hear Prohibition Case Monday Afternoon
The matter will be heard by Federal Judge George W. Anderson next Monday afternoon. Following Judge Brown in Providence granting an injunction on similar issues, there is speculation on Anderson’s ruling. The plaintiff contends the prohibition act is unconstitutional as it enforces national prohibition before the 18th amendment becomes effective and argues it violates the 10th amendment by reserving states’ liquor regulation power until the 18th amendment is enforced. The bill also asserts the 18th amendment permits manufacture and sale of intoxicants for one year from ratification, expiring January 1920.
