Hearing on Plea in Abatement Involving Enemy Alien Claims
Yesterday the case centered on a plea in abatement by Miss Steut who alleges Lobel and others are funded by the German imperial government and that the war between Germany and the United States bars the action. She argues the plaintiffs are German citizens and enemy aliens, with Arthur Lobel claiming Austrian army service before arriving in 1913 and later applying for U.S. citizenship. Judge Creed indicated the matter is difficult, noting the need for fairness, and took the case under advisement.
