Patent infringement profits not provable in bankruptcy case

Court reviews claims against bankrupt Boston and Fairhaven iron works. Cyrus C. Child had won $5640 26 plus $1773 28 costs in a patent profits suit, but the district court refused proof of the claim as a bankruptcy provable debt. The Supreme Court ruling in Root vs Railway Co. denies that infringer profits are a trustee’s profits for the patentee, so the assignees’ appeal is granted and the claim is not provable against the estate.
