The building bought for 560000 yielded equity estimates from 150000 to 300000, with Howe claiming half the profit. After bank failure the asset became Hanover Trust assets. Chmielinski transferred title to the bank commissioner to shield depositors, with profits earmarked for bank benefits. Justice Brayley wrote the decision after Dec 3 arguments by O’Connell and Rowe for Chmielinski, Crowley for Mrs Chmielinski, and Choate for Howe.
