Supreme Court Upholds Prohibition Enforcement Act

The Supreme Court rules the federal amendment and enforcement act valid to enforce prohibition and deny state and federal powers to thwart it. Justices McKenna and Clarke dissent on concurrent power. White writes supplemental opinion clarifying reasoning. One major case remains undecided on storage in warehouses for personal use.

Prohibition Injunctions Dismissed Across Several States

The court denied actions by Rhode Island and New Jersey to bar federal enforcement of prohibition. It dissolved injunctions against Manitowoc Products in Wisconsin over beer with over half a percent alcohol. Dismissals also covered Felgenspan in Newark, St Louis Brewing, Kentucky Distilleries, and George C. Dempsey of Boston, in related enforcement challenges.

Justice White Concurs in Concurring Opinion

Chief Justice White adds to a concurring view, amplifying the subject and reasons. He regrets that a case of this magnitude involves constitutional amendment powers and duties of national and state governments and concerns the welfare of the whole people.

Constitutional View on the Dry Law Powers

The decision explains that concurrent power does not require joint approval by states and that Congress can enforce manufacture and intrastate transactions as well as importation and interstate traffic. It states that the enforcement extends to pre and post amendment beverage liquors and sets limits on federal reach, citing Jacob Ruppert v. Caffey.

McKennes Describe Concurrent Power in Prohibition Debate

Justice McKenna argues that the Eighteenth Amendment grants concurrent power to both Congress and the States to enforce prohibition. He asserts the amendment creates equal, additive authority, requiring united or concordant action to make prohibition effective, not allowing one branch to subordinate the other.
