His Excellency confirms the commutation refusal in a late evening ruling. The decision, based on evidence and guilt, sets Charles L. Tucker for execution by electric chair, following a Tuesday hearing and a controversial statement about the case and the victim Mabel Page.
A woman about 33 years old, height 5 feet 5 inches, medium complexion and blue eyes, was found dead. She wore a white dress with a black underskirt and blue overskirt, black stockings, black lace shoes, and a blue straw hat trimmed with pink flowers. a brass check bearing the number 7 was found on the body.
Patrolman Brown found a well fed woman in a doorway at the corner of Farren and Bunker Hill streets about 3 am. She could not speak and breathed heavily. an ambulance was called, but she expired en route to the hospital. Medical Examiner Harris viewed the body at Undertaker Briggs' rooms. The purse contained a small amount of money and a round brass check with the number 7. Police note she lived alone. autopsy to determine cause of death.
The Board of Aldermen passes a 250000 sale of Deer Island land to the United States government and approves a 50000 appropriation for a Boston publicity bureau. The common council later fails to concur the order by 47 to 18, requiring 50 votes to pass, with Councilman Kiley denouncing the mayoral staff lobbying. Continued on Page 9.
Charles L. Jones 22 a resident of Groton street escaped from the House of Correction Deer Island sometime Monday and remained at large yesterday The jail says the escape was by mistake and Jones is believed to have boarded the steamboat Monitor reaching the city A Jamaica Plain court sentence sent him to the island and he was to be sent to Concord reform school after release He is described as 5 feet 11 inches tall 175 pounds with brown eyes and hair and a tattoo on his right forearm

Governor Guild's decision on the Tucker case was delivered to reporters shortly after 11 PM by Private Secretary Gettemy after the Secretary left the State House. The guarded briefing surrounded by secrecy indicated the governor’s ruling would preclude sending the petition for commutation to the governor's council.
A Post reporter informs Mrs. Tucker that the Governor will not intervene in her son’s case. She weeps but steadies, asks if all hope is gone, and laments the possibility of sending an innocent boy to death. Her husband returns, stunned, as the couple searches for any comfort amid the news.
The governor reviews the Tucker case in depth, detailing a personal investigation and examination of evidence, including the crime scene near Weston and the blood stained corset. Tucker was arrested April 9, 1904, and bound over after a Waltham Police Court hearing.
