Bank case beats demurrer in Pacific Bank suit against directors

In United States Circuit Court Judge Colt rules on two Pacific Bank related matters. He sustains a demurrer to the original equity bill against Lewis Coleman and other directors, saying the pleading must specify exact dates and acts to charge them. He finds the amended bill sufficiently states losses but still calls for more precise particulars on directors duty and timing. Separately, in Price v Whitney, Colt holds executors liable for stock transfers and a failed book transfer. The bank’s funds and the Coburn investment scheme show stock not properly transferred on books, warranting a plaintiff’s judgment for the receivers.
