Governor Foss and his executive council reject commutation for Silas N. Phelps by a 5 to 2 vote, despite Foss’s year of advocacy. The governor declared he would seek to spare Phelps if possible, but the sentence stands unless he acts again.
William A. Davenport vents that the Governor can reprieve without the council, while the council argues that its advice and consent are required. Law splits on whether reprieves rest in the Governor alone or with the council. The attorney general says council is necessary, and pending the council meeting, the death sentence could be carried out. Warden Bridges may escort Phelps to the electric chair at midnight Sunday.
Halifax NS December 27 a British steamer Renwick was rammed amidships by the French mail steamer St. Pierre Miquelon about 100 miles east of Halifax and sank with three crew lost. Survivors including Captain Chapman were rescued by the St. Pierre Miquelon which proceeded to North Sydney with the rescued. The Renwick carried coal for Inverness Coal and Railway from Port Hastings to Bridgewater. the French steamer remained uninjured and continued voyaging tonight.
Yesterday's developments in the beef trust case revealed two failed merger efforts in 1902. First plan merged Armour Swift Morris and Cudahy with $923 million capital. second plan sought $525 million but faltered in tight money markets. Financiers led by Harriman and Stillman were slated to collect about $10 million in commissions. Attorney Veeder of Swift & Co. described merger attempts and provided history of the packers' combination. The contract cited annual earnings of $20,375,000 and tangible assets of $197,500,000.
Crowds line the streets and flood the Essex county jail as William P White, pardoned ex mayor of Lawrence, exits in July 1909. He thanks Governor Foss and supporters at his home after a lengthy pardon process, recalling the prior 17 months in jail and a large crowd at his release.

Rhode Island Coal Company stock fell to 47 cents after Henry M. Whitney, its president and largest shareholder, retired from the East Boston Company presidency. The split of the Rhode Island and East Boston firms and Governor Foss’s shifting stake fueled political tensions and renewed talk of Foss Whitney disagreements.
The retiring Whitney shifts focus to Rhode Island Coal causing a boom bust at East Boston Company as Rhode Island Coal plunges from 12.50 to under 1.00. Whitney defeats Foss’s pro rata plan, buys back shares, and predicts weathering the crisis while denying current heavy holdings.
Daniel J. Kelley of 41 Oliver Street Cambridge died two hours after being crushed beneath a moving electric car in the Park Street subway yesterday at 6 45 pm. Hundreds watched in horror as station workers freed him after six minutes of frantic effort. Kelley suffered a severed leg and massive injuries then briefly regained consciousness at Relief Hospital before dying.
Kelley living on Oliver street was fatally injured when boarding the outbound Mt. Auburn car at berth two. He fell into the gap between platform and rails as the rear truck passed over his legs. Officials on scene included James Smith superintendent, Station Masters Burns and Doyle, and Electrician Harris. Continued on page six.
A major fire gutted the Mount Pleasant stables on Dudley Street Roxbury early today. The blaze began on the second floor where about 52 horses owned by Harry Rosen were housed and quickly spread to the roof. Three alarm dispatches summoned extensive apparatus to control the flames in the thickly settled tenement district.
The origin of the blaze is undetermined as a state police investigation begins. Horses were rescued from the burning stables at 516 and 518 while adjacent express company stables also saved their stock. The building and hay were destroyed, with floor collapse and walls left standing. Damage is about 10000 dollars. Local residents near the flames were evacuated and several people injured including William Devine who was kicked by a mule. The fire was reported by State Officer Thomas Thompson and Chief Mullin supervised the response after the third alarm.
