Judge Rules Drunken Conduct Not Criminal If Not Offending

Chief Justice Aiken tells jurors in Walter H. Slattery case that intoxication alone is not a crime if it does not harm others. Slattery, accused of larceny of an automobile and operating under the influence, was found not guilty of larceny and acquitted on the liquor charge. He had four months for larceny and four months for the DUI in the lower court but received a clean bill of health on retrial. He was recently out of army service and represented by James E O Connell of 53 State Street.
