Convicted Murder Trial Delayed Over Judge Illness and Appeal
The West Virginia Supreme Court denied Frazier’s motion to keep Southern in Mercer County Jail during his appeal after Judge Howard M. Jarrett’s illness and Judge William C. Bivens Jr.’s disqualification. Assistant Prosecutor Deborah Gibson opposed the request. The petition, filed by attorney John R. Frazier, sought suspending a sentence order so newly appointed lawyers could access Southern before appeal. The board discussion involved parents protesting Kessinger’s appointment and prep for future actions.
