Washington reports on the government’s push to regulate the coal industry under wartime powers. Carter Coal Co. challenges the 15 percent coal sale tax and seeks temporary and permanent injunctions, while the industry braces for an $11.6 billion shift and the arrival of the code governing wages and hours.
A six week miners strike in Eastern Tennessee and Southeastern Kentucky ended with a wage agreement between the Southern Appalachian Coal Operators Association and William Turnblazer of United Mine Workers District 19. The pact raises daily wages by 50 cents plus yardage and dead work increases and ten percent for loading.
An earthquake centered on Helena, Montana, rocked a 500 mile area killing at least two and injuring scores. Buildings collapsed in Helena, while western Montana towns like Butte Great Falls and Anaconda were jolted. Toll rose to seven with two new deaths near Salt Lake City. Weather worsened as residents fled into near zero temps.
West Virginia asks for November WPA relief grants with only about one sixth of workers placed in jobs. WPA figures show 8,109 employed on WPA, 6,709 on WPA projects, 1,400 on other federal works, plus 10,000 in Civilian Conservation Corps camps. Total relief funds for October were 1,029,402 dollars.
The treasury postoffice interdepartmental committee announced a new Oak Hill post office will rise on the east side of the turnpike opposite Summerlee. The government will buy the ground for 10000 dollars from Lewis and Butler.
Washington dispatch reports Harry L. Hopkins blasted critics as he announced the federal direct relief dole will end in 20 states on November 15. He condemned General Hugh Johnson’s claim the work relief program fails and clashed with Govs Landon and Talmadge over state finance and policy.
A committee of agriculture economists and lawyers was disclosed as surveying all paths if the AAA is struck down by the Supreme Court. They consider substitutes such as a general sales tax, an excise tax on agricultural commodities, higher income taxes, or a foreign loan to restore purchasing power. Secretary Wallace said he has not conferred with the committee.
John Smith, after a change of venue was denied, pleaded guilty to involuntary manslaughter in the Gilbert accident that killed five pedestrians on July 27. A 12 month sentence was imposed by Judge Beno F. Howard who rejected probation. Willie Steele was cleared of manslaughter charges.
Two police stations in Milwaukee were bombed overnight, raising the total blasts at public buildings and banks to five since last Saturday. One person was injured. The No. 5 station at Third and Hadley was heavily damaged with a blasted wall and shattered windows. A pedestrian was cut by flying glass.
Gov. Kump marked his 56th birthday in Charleston with nine hours at his desk. A crowd of state officials offered congratulations and three aides presented roles. Twenty friends dined with him at the mansion tonight.
Washington reports H. J. Hunt, counsel for the National Bituminous Coal Commission, argues section 14 of the Guffey Act requires government and contract firms to purchase code coal. The Treasury procurement division now directs all government departments to buy code coal and insert compliance clauses in contracts.

In Charleston W V October 31 eleven state troopers received promotions to fill vacancies in commissioner and non commissioned ranks. Captain H N Rexford named acting inspector of personnel and in charge of a training school. Captains Arnold Moore Mack Streagle and George Skeen head Company A B and C. Headquarters Sergeant C W Ray becomes lieutenant in charge of the identification bureau with sergeant W B Tyree as headquarters sergeant. Other promotions include sergeants corporals and troopers across ranks.
Banking Commissioner George Ward authorized payment of 112000 to depositors of the closed Central Bank and Trust company in Charleston West Virginia. Ward also approved reorganization of the Marshall County Bank of Moundsville.
