Castle backs DEP mountaintop mining study despite limits

West Virginia DEP faces moves to curb a federal led mountaintop mining study with four southern lawmakers co sponsoring a measure. DEP director Michael Castle calls the caravan a checks and balances exercise and notes the two year study will produce a final environmental impact statement by December. The case stems from a Bragg suit over Clean Water Act provisions and a consent decree guiding land surrender and forest conversion. In Virginia a federal appeals court review of stream buffer zones adds to regional uncertainty while Castle continues regional outreach to assess DEP performance.
