Eight-year-old King Coal Highway suit kept alive in WV
The West Virginia Supreme Court, in a 4-1 decision, allows ACT to pursue its claim against the Division of Highways and Alpha Natural Resources over a no-bid contract for a 14 mile King Coal Highway segment. ACT argues workers were underpaid and the suit dates to 2009 when 20 families sued. The highway remains largely incomplete with under a mile open.
