Judge Rules Board Lacks Authority to Alter Sentence Terms

Special Judge Everett F. Moore ruled that the state probation and parole director cannot change a prisoner’s sentence from a definite term to an indeterminate one. The state gave notice of appeal through Marshall county Prosecutor J. W. Rickey and a 10 day stay of execution was ordered on a habeas corpus writ for J. E. Cohn. Moore did not rule on other issues while serving in the legislature during Judge Shipman’s illness.

Cohn challenges 1939 in determinate sentence law

Cohn appeals the 1939 in determinate sentence act claiming illegal detention since May 18 1940 after the probation and parole director altered his one year term for a bad check to one to five years. About 300 prisoners face impact if the law is ruled unconstitutional. Moore argues the probation and parole department is administrative and only the Wood county circuit court can correct the sentence where it was imposed.
