Massey Energy moves to curb MSHA over mine ventilation
Massey Energy says it will sue the federal government to limit MSHA's influence on how coal mine ventilation is run, seeking to confine oversight to plan review for prudent engineering and to add a due process appeal. The suit claims current law lacks an impartial mechanism to challenge MSHA ventilation decisions. Massey cites the Upper Big Branch disaster and says mines deserve a right to recourse when plans are contested.
