Appeals Court Turns Down Coal Anti-Trust Suits
The 6th U.S. Circuit Court of Appeals ruled there is no direct evidence that the United Mine Workers and the Bituminous Coal Operators Association conspired to force wage and labor standards on nonmembers. The ruling upheld dismissal of two anti-trust suits brought by 15 coal companies and Tennessee Products and Chemical Corp. The court noted no direct conspiracy evidence and found pricing by West Kentucky Coal Co and Nashville Coal Co to be based on legitimate business considerations.
