Mercer County jail sentencing challenged in federal action
Mercer County Commission and Sheriff Hare plan to file a federal civil action in Charleston to stop two circuit judges and three magistrates from sentencing offenders to the county jail or state facilities if it violates a 1983 court order. They argue governor Moore's executive order over crowded prisons renders current incarcerations noncompliant and could push jail and prison populations beyond permitted levels.
