West Virginia Supreme Court unanimously ruled the 1976 legislative rule making act unconstitutional for allowing legislative overreach into executive power. The ruling nullifies the Rule-Making Review Committee’s five year authority to overturn agency regulations. In a second ruling the court limited retroactive pension effects from a 1979 salary law, affecting judges past and present. Justice Darrell V. McGraw Jr. wrote both opinions. Justice Thomas McHugh did not participate.
