States seek rehearing on freight rate ruling
Officials from 15 states including New York New Jersey Ohio and Pennsylvania petition the U S Supreme Court to rehear its 7 to 2 decision upholding an ICC order raising class railroad freight rates 19 percent in the north and east and cutting them 10 percent in the south and west. The petitions argue the court erred by replacing ICC findings with its own and by not recognizing rate structure differences as a factor in economic conditions across regions.

Order Confirms Settlement in Brooks Estate Suit
An Order was entered in circuit court confirming settlement of the claim of Opal L. Brooks as administratrix of the estate of George R. Brooks against Norfolk and Western Railway for 6250 dollars. Brooks was killed June 9, 1945 at Bluefield while repairing brakes on a tender in the roundhouse. The brakes were operated by another employee and Brooks' head was caught in the live brake. Judge Easley also considered City of Bluefield’s motion to set aside a jury verdict for 2716.75 in favor of Maude V. Smith against the city over a sidewalk injury. The city argued the sidewalk was not in repair and that Smith was contributory negligent after stepping on a raised concrete section.
