Benefits dispute review granted in West Virginia
Charleston W Va Feb 17 A review of a two year old dispute over unemployment compensation for idle Appalachian miners during the 1939 shutdown was granted by the state supreme court on application by the United Mine Workers. The court issued a writ of certiorari to possibly place the case on the April or September docket. About 100000 West Virginia miners were idle seven weeks in 1939 while a new contract was negotiated. The decision may affect roughly 20000 appeals and total payments around 5 million dollars. The legislature is considering amending the labor dispute clause to allow benefits when workers accept less favorable conditions or are denied bargaining rights or when a plant shutdown or mass dismissals occur to force wage cuts.
