Mercer County Grand Jury returned 96 indictments last week naming Richard Anthony Hart 46 of Matoaka and Roy Lee Williams 41 of unspecified, both charged with violent offenses including attempted murder and kidnapping. Mercer County magistrate Rick Fowler officialy retires following a JIC probe into sexually explicit Facebook messages with a woman who appeared in his court. He submitted a letter to Chief Judge Derek Swope stating his retirement from the magistrate court and public life. Fowler asks the judge not to appoint two rivals, citing defamation concerns by Charlie Poe and John McGinnis.
US District Judge Thomas Johnston ruling leaves 45 year old Dallas Toler jailed awaiting sentencing for a voter fraud conviction. Prosecutors allege he violated bond by trying to sell cocaine and allowed others to use his vehicle to transport what he believed was cocaine. Sentencing set for March 10. Toler wore an orange jumpsuit and is held in South Central Regional Jail. An unidentified individual agreed to cooperate as a confidential informant.
A mistrial was declared in the case of John Spaulding 41 of Montcalm after a juror fell ill during deliberations. Mercer County Circuit Court Judge William Sadler scheduled a new trial for March 31 at 9 a.m. and final pretrial motions for March 17 at 9 30 a.m. Spaulding faces six counts of sexual assault first degree attempted to commit a felony and 50 counts of possession of material depicting minors in sexually explicit conduct.
