High court upholds Tierney will in charitable trust case
The West Virginia Supreme Court unanimously affirmed a Mercer County ruling that Katharine B. Tierney's will validly created a charitable remainder trust and foundation. The $2.2 million fund will fund annual gifts to charities and educational institutions, with Ann Tierney Smith and her children entitled to participate in distributions. The decision confirms Tierney's intent as stated in her trust documents and preserves the estate’s philanthropic purposes.
