Welch Water Power Mandamus Case Seeks Levy Change

In the Supreme Court of Appeals the Welch Water Light and Power Company seeks a writ of mandamus against Welch to force a municipal levy sufficient to pay $5 115 41 in outstanding indebtedness. Attorney Townsend argues the 1908 acts cap levies at 85 cents per 100 dollars, with a 10 cent special levy to liquidate pre 1908 debts, and that the legislature has sole power over municipal finances. The town denies legality of the debt, claiming warrants are invalid and that only bonds authorize indebtedness, while acknowledging a moral obligation to liquidate pre 1908 debt under the 10 cent levy provision.
