The Supreme Court refused to halt military jurisdiction over Nazi saboteurs and upheld President Roosevelt’s order to try them by a military commission. The court asserted its authority to review wartime power while letting the commission proceed to final arguments, moving toward a conclusion.
Richmond Virginia July 31 The Federal Reserve Bank reports coal production in the district rose to 15 718 000 tons for the period with West Virginia producing 13 750 000 tons. May output was exceeded by 454 000 tons and June 1941 by 715 000 tons. War effort stocking and bond purchases fueled the rise while loan volumes and notes in circulation edged down.
New York held a nighttime air raid practice alert plunging the city into its first citywide blackout of the war. Mayor La Guardia had warned such tests could occur before August 5. An Army spokesman declined comment, stating it was the mayor's party. AP reported the drill with live coverage from an emergency station beneath the city. The all clear followed at 10:15 p.m.
James C Petrillo president of the American Federation of Musicians announces a ban on recording for radio and public use by 138000 members effective at midnight The ban covers 95 percent of music heard in the United States and Canada The letter to Elmer Davis of the Office of War Information questions the government's role in the dispute and notes the ban excludes recordings for the armed forces and the President
The Mercer county jury found Harry P Walters formerly of Bluefield not guilty of the murder of Howa Abbott a colored attendant at the Bluefield American Legion club rooms The trial spanned from Monday to Wednesday ending with a verdict delivered in court yesterday morning The defense had argued temporary insanity due to alcohol use by Walters wife and Walters faces no further charges in this case.
An admiralty communique states the French destroyer and naval planes retook the vessel Mjidia from a British-surveillance crew. The ship was en route from Oran to Marseille with wine and minerals when seized July 26. The ship carried no war contraband.
London reports mounting strategy talks hint at quick action to aid Russian allies in western Europe. Brit sources say Russia may press for air bases in Scandinavia to protect Arctic convoys while Japan masss troops on the Soviet frontier. A Western diversion and Murmansk supply solution could shape a new Allied approach.
Washington July 31 Engineers disclosed before a senate subcommittee a flying cargo craft using engines helium and air for lift. The proposed 200 by 180 foot craft would carry 12 fighters take off from a platform using helium to lift 36 tons and engines to lift 70 tons. The craft aims to combine heavier and lighter than air ideas to form a sky roaming carrier without heavy ground support.
War Production Board chief Donald Nelson signaled support for Henry J. Kaiser to convert West Coast shipyards to produce 70 ton cargo and troop planes if engines and parts can be spared without harming current military aircraft needs. Kaiser said a full go signal could trigger immediate capacity changes. A May report will outline feasibility and expansion plans.
Former Governor H G Kump charged Governor M M Neely with delaying his campaign message and aiding enemies of the country. He likened Neely to Huey Long and attacked the attorney general's election ruling, urging voters to consider the law and integrity in the wartime election.

The Navy announced a medium sized Panamanian merchant ship was torpedoed July 18 in the Atlantic off the northern coast of South America. Survivors have been landed at a U S east coast port.
Police probe deepens into the tale of a ghostly intruder at Moncrieff Place in Denver. The wisp of a man, said to be 75 pounds, killed Philip Peters 73, a retired railroad auditor, then hid in Peters attic for months while hunger and eerie sounds drew investigators. Peters’ wife and nurses moved in and out as the ghost roamed the house and claimed the icebox for food before being discovered.
Moscow reports a renewed halt to a Nazi push in the Kletskaya area about 80 miles northwest of Stalingrad as Soviet reserves rush in. In the Don river region near Rostov, a Russian unit killed over 1,000 Germans who crossed the barrier, while tanks guns and troops were lost on both sides in new retirements and local clashes.
Beckley West Virginia July 31 Federal Judge Ben Moore found Sheriff Ash Mankin and H P Thomas guilty of contempt and placed them on 60 day probation while awaiting a federal order to improve conditions at Raleigh County jail. If conditions fail they face 90 day terms in Ashland Kentucky federal prison. The judge praised the sheriff but urged humane treatment of prisoners and noted civil liability could apply.
