Montana Will Set Aside by California Court
In Oakland the superior court invalidated the will of Benjamin J. Phillips, a former Montana cattle king, ruling its terms conflict with California law. His daughter Mrs. Sarah Newbell, of Oakland, sought to gain immediate access to a one fifth share of the $2,900,000 estate. The will had left equal shares to five children with daughters receiving only trust interest until their children reach 25. Real estate in California valued at $120,000 and Montana ranches were involved. three Phillips brothers argued breakup would reduce value. Phillips died in Rochester, Minnesota, in November 1926.
