Fifth Rights Case Reversal Won by Rev Shuttlesworth
Washington The Rev. Fred L. Shuttlesworth won his fifth Supreme Court reversal of lower court civil rights rulings in a unanimous decision. The court voided a loitering conviction tied to 1962 civil rights protests in Birmingham, ruling only obstructing a sidewalk when not blocking passage could be constitutional. The second conviction on failing to obey a police order was deemed due process lacking as traffic wasn’t involved. Justice Fortas noted a possible new trial though, while Douglas concurred that guilt was not supported by evidence.
