Cloudy conditions continue tonight and Tuesday with little temperature change and showers in south and central portions. Low temperatures expected in the upper 40s to low 50s. Sunset at 8 36 p m and sunrise at 5 10 a m.
The Supreme Court ruled 7 to 2 that a 102 year old federal statute guarantees Negroes the right to buy, lease, or hold property wherever a white citizen may, applying 1866 language to private individuals. Justice Stewart led the majority in upholding Open Housing rights while noting Congress intends federal enforcement to back these protections. The court also struck down Alabama’s welfare rule requiring a substitute father, impacting similar laws in 18 states and D C, in a separate ruling. Mrs. Sylvester Sith of Selma, a Black mother, sued after welfare was cut off. suit backed by the ACLU Roger Baldwin Foundation.
Pfc. For rest E Ward, 21, of Bennington, attached to a medical battalion in Vietnam, has been reported killed in action. Born April 27, 1947, he lived with his mother Mrs. Hector J. Ward of 901 Gage St. His father is deceased. A Union Springs Academy graduate, he attended Atlantic Union College for two years and trained at Fort Sam Houston. His mother expects official confirmation today. He leaves a sister Mrs. Henry Buck Jr. of Troy New York, a niece and a nephew.
UPI reports American jets shot down seven Communist helicopters used near the DMZ for the first time in the war. The raids included 142 missions against North Vietnam's southern panhandle, with U.S. Marines claiming heavy casualties and several aircraft losses on both sides. Soviet-made MiG intercepts were noted but no dogfights occurred.
Pittsfield Mass Bruce McConnell 22 of North Adams was ordered to serve an 8 to 12 year term at Walpole State Prison for the death of Bonnie Briggs Pearson 19 of Newport N H. He was sentenced in Berkshire Superior Court after pleading guilty to manslaughter in the Williamstown garage death found last August. He had been on trial for first degree murder before changing to manslaughter last Friday.
UPI reports CATV systems, about 1800 in number, are not required to pay copyright fees for programs like movies and cartoons they receive from regular TV stations. CATV uses large antennas to pull programs from the air and transmit them to subscribers by cable. Originating stations pay fees on copyrighted programs, but CATV operators do not assume this obligation. The issue centers on whether CATV transmission constitutes a public performance under copyright law, Fortnightly Corp. involved.
The Executive Council of Actors Equity Association meets to decide if a strike will be called that could darken Broadway theaters. Negotiations with the League of New York Theaters have been in recess since Thursday and no talks were set for the weekend.

Former President Dwight D. Eisenhower remains alert and in good spirits at Walter Reed Hospital after suffering his fifth heart attack Saturday night. A 10 a.m. bulletin reported stable vital signs with no recurrence of pain since the initial episode, and Mrs. Eisenhower has visited him frequently. John Eisenhower and the general’s brothers have been kept informed as doctors monitor his condition and consider plans for potential home discharge.
Paris reports the Renault plant vote to return to work signals near end of the countrywide strike. Police evicted 3,000 students from the Sorbonne after clashes, lifting red and black flags and raising the French Tricolor. unions at Citroen Peugeot and others expected to follow with walkouts ending.
Supporters of the Pavilion Hotel prepared to present preservation arguments at a Tuesday hearing by the Legislative Council Pavilion Hotel Study Committee. Edwin W. Small of the National Park Service and James M. Fitch of Columbia University will oppose demolition, arguing the hotel’s historic value amid a two year battle since the state bought the property for 148000 dollars.
