Supreme Court acts in two murder cases
Vermont Supreme Court upholds Superior Court mistrial for Scott Dunkerley in Walden murder trial after a collapsed lung, and preserves first degree murder conviction of Robert Reuschel in a 1970 case. Court also reverses a murder appeal, ruling on improper prosecutor statements, and decides nonrenewal of John Fairchild’s 1975 76 teaching contract. It also sustains ANFC payment adjustments for a family with tax difficulties.

Vermont Supreme Court nixes public nuisance to close porn shop
The Vermont Supreme Court unanimously ruled that a public nuisance claim cannot close Twin City News, saying the concept is vague and risks infringing protected speech. The Health Board order lacked a specific obscenity standard and state law does not ban adult pornography distribution to adults. The decision may shift focus to legislative action on obscenity.

Bennington selectmen defer Y-Woods decision amid budget gaps
Bennington selectmen, in a long meeting, delayed final action on the Y-Woods day camp pavilion project as a projected combined general and highway fund deficit of 8,500 dollars emerged after revenues were underestimated. They reviewed a water anti corrosion system and learned the town manager will reapply for about 368,000 dollars in federal funds to replace lead lines in low and moderate income homes. Budget gaps included an 8,500 hole after revenue subtraction, a 66,362 overrun in the highway fund from weather, and a 17,001 projected June 30 general fund deficit. A proposed 13,000 used backhoe purchase was discussed but no funding source decided. The board split on recreation spending with Morrissey absent and a vote to approve the Y-Woods plan postponed until the full board returns in about three weeks.
