Town Ordered to Open Green Mountain Beach to All Taxpayers
A Windham County court in Newfane ordered Wilmington to allow all taxpayers to use Green Mountain Beach on Lake Raponda. Judge John P. Morrissey granted a temporary restraining order at the request of Barbara S. Schiffer of Levittown NY, who owns land in Wheeler Village but was denied a beach pass. The town ordinance limits access to inhabitants defined as full residents, prompting claims of unconstitutional privilege and discrimination against nonresident taxpayers. The town was told to halt enforcement and show cause by Aug 9 why a preliminary injunction should not be issued.
