Court overturns Manchester variance ruling on zoning permit
In Manchester county court an appeal over a Manchester Zoning Board of Adjustment variance to convert the Montgomery Ward building into a combined office and retail space was decided against the board. The court vacated the variance, finding the application and advertising differed and that no undue hardship was shown beyond potential rental income. it criticized the board’s record keeping and noted the property’s non conformance due to lack of off street parking. Sloman, owner, indicated a new tenant, Wilson Clothing Shop, will occupy the space under the existing non conforming use.
