Barber Rules out Bennington Reapportionment of Mt Anthony Board
Town counsel Norton Barber advised Bennington Selectmen that any effort to force a reapportionment of the Mt Anthony Union High School Board would be illegal. He said school boards are administrative bodies of districts that are independent municipalities, outside selectmen’s authority. The issue arose from a petition by Col Raymond C. Murray of the BTPA asking voters to authorize challenging the school board’s composition. Barber warned that funding such a challenge could be illegal and could involve costly litigation up to the Supreme Court. He noted the selectmen’s wide but limited authority and clarified Bennington has no town school district.
